Assessing the resilience of the French legal order to an authoritarian shock

This study commissioned by Greens/EFA MEPs Gwendoline Delbos-Corfield and Philippe Lamberts, and coordinated by Professors Laurent Pech and Sébastien Platon

 

In the same way as Hungary and Poland have already become hybrid regimes, could France be next? Considering the quick and systemic democratic backsliding in these two European Union member states and the recent electoral success of the National Rally - the main French far right party - this is a timely question.
 
Greens/EFA Members of the European Parliament Gwendoline Delbos-Corfield and Philippe Lamberts have asked eight researchers to assess how resistant the French legal and constitutional orders would be to an authoritarian shock.
 
Following the methodology of the European Central Bank Banking Supervision, this rule of law stress test assesses a wide range of legal and constitutional issues, from the separation of powers, to the independence of judges and non-institutional checks and balances. They aim to use the same methodology in the future to assess the resilience of other member states.
 
This event aims to present the main findings of the report, as well as to discuss ways the EU could contribute to better protect against the weaknesses of national systems, and anticipate democratic backsliding among its member states.
