The use of non-custodial measures as an alternative to detention is relevant both as a means to reduce prison overcrowding and as a tool to facilitate the social reintegration of convicted persons and thus to reduce recidivism. However, research seems to show that such positive effects only follow when the use of alternatives to detention is a part of a broader strategy of structural penal reforms, including decriminalisation and diverting strategies: the introduction of alternatives, alone, can actually have the opposite effect of increasing the prison population, due to the so-called “net-widening” effect.
